I chose Dr. Kleiner because of his 'supposed' expertise, and his offer of less (non) invasive posterior procedure that would yield same results as more invasive (anterior/posterior). I am an avid runner/biker and so his procedure was a 'no brainer'. He performed a Level 2 spinal fusion (L4-L5-S1). After 5 months it was discovered that S1 pedicle screws were loose, and L5-S1 was diagnosed as non-union (pseudarthrosis). I accepted this, knowing that the more levels fused, the greater the chance of this happening. Upon revision surgery (8/2012) of removing ALL hardware (rods/screws) posteriorly, he re-fused L5-S1 anteriorly using plate, cage, etc. and supposedly determined that L4-L5 was adequately fused. Therefore, he did not substitute any instrumentation offering any permanent support. Prior CT indicated otherwise, with his colleagues (spine surgeons/radiologists) confirming L4-L5 as NOT being fused/healed. The email conversation below is a clear admission of his surgical negligence:

Sorry to be a pain and rehash my fusion, but can you please tell me your impression of the status of each (i.e. fully fused, partially fused)? I am getting some conflicting opinions. (another spine surgeon viewed CT and requested MRI).

Response:
Your fusion is best assessed with CT and X/R. Both levels are fused.

In November of 2013 another CT was taken with radiologist reporting: 'there is no evidence of solid bony fusion of the operative levels'.

Response:
I reviewed your CT with Dr. X, one of the neuroradiologists. He thought the L5-S! level was healed and that the L4-5 level was probably not.

So am I fused/healed or not? With all that said, I MUST question/challenge his so-called level of expertise. Also, with regard to radiographs, 'a picture is worth a thousand words'.

The damage was done and I have remained in pain, with a greatly diminished quality of life ever since. Upon seeking legal representation in/around the Denver area, I quickly learned that there were conflicts of interest with every reputable law firm. He is obviously in their ‘back pocket’ as an expert witness.
Unfortunately, he did me more harm than good, and I would NOT recommend Kleiner!
