GUILTY OR NOT GUILTY
SKYLINE LODGE CHOTEAU, MONTANA
YOU BE THE JUDGE

Anyone desiring to move into the Skyline Lodge in Choteau, Montana must sign a document titled APARTMENT FIXTURES during the sign in process. You don’t sign it, you don’t move in. The APARTMENT FIXTURES document makes the signor financially responsible for the replacement of a permanently installed, faulty window air conditioning unit in his or her apartment. Some units throughout the complex, when turned on cause an unacceptable constant thumping that resounds through the floor, walls and ceiling into surrounding apartments. Can you imagine having to listen to a constant, drum like thumping 24/7 during the hot season in Choteau, Montana? A frustrating problem that lies not with the innocent tenant to fix, but legally, the responsibility of the landlord, Mrs. Karen Burkett.

This nefarious action on the part of Real Estate Management, Inc., the HUD Section 8 agent for Skyline Lodge, Mrs. Karen Burkett, landlord of record and Ms. Brenda Johnson, manager of the lodge is/was in violation Montana Housing Laws and HUD federal law. A blatant act of concealment which is a fraudulent civil or criminal act.

On January 12, 2017, I complained to management regarding the 6 faulty window and roof mounted air conditioning units that were thumping and humming through the floors, walls and ceiling of my apartment, unit, 314. Over a period of months, I kept complaining to both the manager, Ms. Brenda Johnson and the landlord, Mrs Karen Burkett. I have documented over 45 emails complaining to the management and the landlord. Instead of fixing the problems I was experiencing, on May 18, 2017, I was served with a Notice to Quit stating my lease would not be renewed and I would have to move out on or before July 19, 2017. I was never late in paying the rent. I had never caused any problems with any of the other tenants. I was not using drugs. And, I kept my apartment in pristine condition. In other words, I would be considered a model tenant. One any landlord would cherish.

On July, 20, 2017, I was served with an Unlawful Retainer And Action For Possession by the Teton County Sheriff’s Department. A clear and blatant act of retaliatory eviction. I was required to appear in court on August 10, 2017. The judge’s ruling, I have to move out no later than August 31, 2017 or be forcefully evicted by the county sheriff. Suffering from many debilitating infirmities and not enough money to get to my new destination, my stepson came all the way from Portland, Oregon, helped me with expenses that ultimately exceeded $3000.00 and drove me to my new destination.
So, beware before you sign. Read the APARTMENT FIXTURES document and get clarification of your responsibility before moving in. Good luck, Ye Olde Sage.
